Need a Lawyer?

Do I need a lawyer?

Of course, this depends on your circumstances. If the accident was minor (i.e. less than $2,000 property damage) and you have not suffered permanent injury, i.e. herniated disk, head injury, broken bones, aggravation of pre-existing injury or illness, etc., then the truth is you may not need a lawyer.

Unfortunately, some lawyers seem to think that everyone needs an attorney for minor car accidents. In fact, lots of lawyers advertise in the phone book and on TV counting on minor accident claims to help them meet their bottom line. These firms operate on volume. They accept a very large number of small value accident cases. They may refer you to a chiropractor if you have muscle soreness but not other problems. Good for the firm and good for their doctor referral, but maybe not so good for you.

If you want to avoid being a number or statistic, then you may want to avoid:

• mega-size firms, where your case is handled by non-lawyer staff, and your luck to even speak with a lawyer; these are "volume" firms, where they seek to handle as many small claims as possible for quick, often small, settlements to pay for their large overhead;
• some TV "referral service" which is trying to send you to a chiropractor and lawyer who are "on their list" -- the fact is you don't anything about these attorneys and chiropractors, their experience, or backgrounds, and must wonder if they put themselves before your interests;
• blindly hiring some lawyer who has paid thousands of dollars for large phone book ads (probably a volume operation which depends on large numbers of clients for small settlements);
• hiring a firm which has a non lawyer staff handle most aspects of your claim, and in some cases, you are lucky if you ever meet your attorney;
• be wary of law firms which make a bunch of promises to you, especially when it comes to how much money you will receive for your injuries. Many firms lure clients in with promises of large settlements, only to come up way short. No lawyer or legal staff should be making promises about a result -- no lawyer is permitted to guarantee a result.

Avoiding Child Injury in Traffic Crashes

We all want to keep our children safe and secure and help them live to their full potential. Knowing how to prevent leading causes of child injury, like road traffic injuries, is a step toward this goal.

child car safetyAccording to the Centers for Disease Control (CDC), every hour, 150 children between ages 0 and 19 are treated in emergency departments for injuries sustained in motor vehicle crashes. More children ages 5 to 19 die from crash-related injuries than from any other type of injury.

  • Across the United States, injuries are the leading cause of death among children ages 19 and younger.
  • About 33 children die every day because of injuries.
  • Each year, nearly 9.2 million children aged 0 to 19 years are seen in emergency departments for injuries, and 12,175 children die as a result of being injured.

Thankfully, parents can play a key role in protecting the children they love from road traffic injuries.

Safety Tips

  • One of the best protective measures you can take is using seat belts, child safety seats, and booster seats that are appropriate for your child’s age and weight.
  • Typically, babies should be placed in rear facing car seats until they are at least 1 year old and weigh 20 pounds.
  • When babies move into front-facing car seats, they should remain in these seats until they are at least 4 years old or weigh 40 pounds.
  • Children should be seated in booster seats from about age 4 to age 8, or until they reach 4’9” tall.
  • All children ages 12 and under should be seated in the back seat of vehicles.
  • If you’re a parent of a teen who is learning to drive, sign an agreement with them to limit risky driving situations, such as having multiple teen passengers and driving at night.

It’s a dangerous world out there on our roads and highways.  Keep your kids safe when they’re out there:  an ounce of prevention is worth a pound of cure.

Woman Accused of Causing Brain Injury to Child

According to reports, a North Naples woman is accused of  abusing a 5 month old baby causing brain injury.  The allegation is that the babysitter caused the child injury, resulting in brain injury marked by vomiting, shaking, and going limp.  The babysitter has been charged with aggravated child abuse and is in jail without bond.

The babysitter has claimed, according to reports, that the child was harmed when a toy struck the child’s head.  The child’s brain injury was reportedly not  accidental per treating doctors.  Deputies claim the babysitter is the one responsible for the child injury.

Simply a very sad story, whatever the facts may really turn out to be (again, the criminal charges are allegations only at this point).

Children are our most precious gifts, and our must vulnerable. As parents and caregivers, we want and need to give them the care, guidance, and love, to help them fulfill their potential and purpose. We all have to do better.

Child Burned by Electrical Transformer

According to the Sarasota Herald Tribune, a 6 year old boy suffered a severe burn injury when he was outside playing near an allegedly defective electrical transformer outside his home.  The young boy suffered severe electrical burns over much of his body.

According to the report, The 6 year old reached inside and touched a live wire.  The electric shock lifted the boy off his feet, scorching his face and arms, and melting his clothes to his skin.

A neighbor performed CPR to restart the boy’s heart before he was taken to Tampa General Hospital, where the six year old was in intensive care for more than two weeks, often on a ventilator and feeding tube.

Doctors grafted skin from the back of his thighs and his bottom onto his charred torso. Doctors had to cut dead tissue to save parts of the boy’s body. He was in the hospital for more than 2 months.

High Chair Recall

The Consumer Product Safety Commission has recalled 1.2 million Graco Products high chairs, according to reports.  According to the CPSC, that the risk of child injury is high, and that to date it knows of 24 incidents in which the high chairs have tipped over due to:  screws holding the front legs of the high chair can loosen and fall out and cracking plastic brackets, resulting in child injury.
